Supreme Court Justice Brent Benjamin has rejected the latest request that he recuse himself from a pending appeal involving Massey Energy Co.
As The Associated Press reports, Benjamin refers to his previous refusals and also took a swipe at lawyers for Wheeling-Pittsburgh Steel Corp. and Mountain State Carbon LLC, saying they had included "inaccuracies and innuendo" in the latest request.
Those lawyers argued that Benjamin had failed to address the argument that he faced the appearance of impropriety over the estimated $3.5 million spent by Massey's Don Blankenship to aid his successful 2004 election campaign.

Innuendo is no reason to for recusal. I agree with Brent. If every judge had to recuse himself every time a campaign contributor had an interest in a case before him/her, there would be no decisions at all.
You forgot to mention whether Starcher was going to recuse himself from this case like he did in the last one or not. Oh wait, you are a liberal reporter with an agenda and that would not have served your purpose. Maybe next time, though, huh Lawrence?
Didn't the voters of WV have to vote Benjamin in?
I don't recall Don Blankenship having the power to appoint court justices.
If he's being accused of buying Benjamin's seat, I'm a little pissed because I never got any money from Don for my vote.
