"I don't think it is fair for one kid to make a mistake and punish 40 other kids on the team."
-- Supreme Court Justice Elliott "Spike" Maynard, explaining his dissent to the recent ruling that stripped Martinsburg High's football team of two wins because it had fielded an ineligible player. The Parkersburg News covered Maynard's speech to the local Rotary Club.

So, Spike believes the one kid made the decision to join the team without checking his own eligibility? Riiiight.
What about punishing the players from the other schools who would get worse seedings because the one kid cheated and the school made no effort to prevent it. That's a lot more than 40.
Some kids get punished no matter which way the ruling goes. Only someone with the inability to reason or simply in favor of cheating would come down on the side of punishing the kids from the school that did nothing wrong rather than the school that did wrong.(What a shock such a person would be found on the court. it's even more shocking he's a Mingo county pol))
I disagree with Spike here. He let his politician side show a bit. While I generally agree with his criminal rulings, he's wrong here.
That said, I think he's the real breath of fresh air on the court. His dissent in the Mullens case was the best one I've ever read from any court.
